[OSCURATO:PERSONA] ([OSCURATO:PERSONA]) 9 July 2015 ( * ) (Rectification of judgment) [OSCURATO:PERSONA] C‑585/13 P REC, APPEAL under Article 56 of the Statute of the [OSCURATO:PERSONA] of Justice of the [OSCURATO:PERSONA], brought on 19 November 2013, [OSCURATO:PERSONA]-[OSCURATO:PERSONA] AG, established in Hamburg (Germany), represented by S. Jeffrey, S. Ashley and A. Irvine, Solicitors, H. Hohmann, Rechtsanwalt, D. Wyatt QC and R. Blakeley, Barrister, applicant, the other parties to the proceedings being: Council of the [OSCURATO:PERSONA], represented by F. Naert and M. Bishop, acting as Agents, defendant at first instance, [OSCURATO:PERSONA] of [OSCURATO:PERSONA] and [OSCURATO:PERSONA], represented by V. Kaye, acting as Agent, and by R. Palmer, Barrister, [OSCURATO:PERSONA], interveners at first instance, [OSCURATO:PERSONA] ([OSCURATO:PERSONA]), composed of T. von Danwitz, President of the [OSCURATO:PERSONA], C. Vajda, A. Rosas (Rapporteur), E. Juhász and D. Šváby, [OSCURATO:PERSONA], [OSCURATO:PERSONA]: P. Mengozzi, Registrar: A. [OSCURATO:PERSONA], after hearing the [OSCURATO:PERSONA], makes the following [OSCURATO:PERSONA] 1 On 5 March 2015, the [OSCURATO:PERSONA] ([OSCURATO:PERSONA]) delivered its judgment in [OSCURATO:PERSONA]-[OSCURATO:PERSONA] v Council (C‑585/13 P, EU:C:2015:145). 2 That judgment contains errors which it is appropriate for the [OSCURATO:PERSONA] to rectify at the request of [OSCURATO:PERSONA]-[OSCURATO:PERSONA] AG pursuant to Article 154(1) of the Rules of Procedure of the [OSCURATO:PERSONA] of Justice. On those grounds, the [OSCURATO:PERSONA] ([OSCURATO:PERSONA]) hereby orders: 1. Paragraph 114 of the judgment in [OSCURATO:PERSONA]-[OSCURATO:PERSONA] v Council (C‑585/13 P, EU:C:2015:145) shall be rectified as follows: ‘Since the Council has applied for costs and the appellant has been unsuccessful, the appellant must be ordered to bear its own costs and to pay those incurred by the Council.’ 2. Point 2 of the operative part of that judgment shall be rectified as follows: ‘[OSCURATO:PERSONA][OSCURATO:PERSONA] AG to bear its own costs and to pay those incurred by the Council of the [OSCURATO:PERSONA].’ 3. The original of this order shall be annexed to the original of the rectified judgment. A note of this order shall be made in the margin of the original of the rectified judgment.
